However, the evidence he uses is something that he had no control over:

"As consumer spending rises, manufacturers are seeing more new orders for their goods," Bush said. "Low interest rates mean businesses have better balance sheets, and families have saved billions of dollars by refinancing their homes. These are the signs of a reviving economy."

Excuse me, Mr. Bush, if it weren't for low interest rates, and the lowered monthy payments and cash-out refinances that have put more money in the hands of home-owners, this economy would probably have been in a depression. And as we all know, Alan Greenspan and the Federal Reserve determines interest rates. The refinance boom has allowed more people to have more money in their pockets, and it has also created many jobs in the mortgage business (as well as keeping title companies, escrow companies, and appraisers busy). However, this has absolutely nothing to do with the tax cut. In fact, the tax cut is most likely the major reason for the recent rise in interest rates.

"The Jobs and Growth Act I signed in May ensures that workers enjoy more of the benefits of their work through more take-home pay," he said. "Tax relief was based on the conviction that workers are entitled to keep more of their hard-earned wages. That belief, after all, is why America celebrates Labor Day and not tax day."

That's a good idea and great if the middle class has jobs. However, the percentage cut to the middle class really has not put a significant enough amount of money in their pockets to fuel spending. If anything, the extra spending has come from Americans taking equity out of their homes. And I don't believe there's been any significant improvment in the unemployment rates, either.

I don't want a bad economy, and I don't wish that the President's "economic recovery plan" doesn't work. But I do wish that the President would level with us, and that he would seek sound economic advice, instead of having his cabinet stacked with yes-men. The Administration's own studies showed that this tax-cut package would not help the economy, so they fudged the numbers and went on ahead with it anyways. Will you please learn some basic economic principles, Mr. President?

Here's something from the wall street journal's opinon page. I've been in a state of shock and awh a bit myself I guess. I dont really think I need to say innocent lives should be killed and I dont think I need to say Saddam is evil because of course both are true and not mutually exclusive, thats just the retoric of the everyday. What I want to say is history is harder to make than I thought. Right now I can see very different histories that might come into play, is this the war for the liberation of Iraq? Is this the war that marks an independent Kurdistan? Is this a cultural war if so is it east vs west or money vs poverty? Is this about a people? Is this the second war for 21st century colonies? Is this the war to hide the fall of the middle class in America? I'm sure its elements of all of this but the issues that will be discussed in the comming days I think is the war. What about international levels of mass distruction? Isnt the United Nations a good way to try to reduce arms through out the world, have we lost that oppertunity for ever? Why are democracies taking the lead in action? I dont really know all the answers of course but i'm just so filled with lots of little thoughts I'm still trying to gather them up. And I'm pissed cuz I havent been able to go to any teach-ins to kinda hear what the left intellegencia has to say other than the extreem and the fringe. Partially my fault because i'm not lookin really hard. And I'm conflicted because if you ask any Iraqie immigrant they will tell you they are all for the war but is that because they are all ex-pats liveing in the U.S. now or what? Anyways there is alot of suff I havent even discussed yet. I'll try to get to it. But i'm very pensive about this war, I'm usually opposed to any American intervention to regional conflicts. I'm worried that the United Nations is gonna get the shaft on the issues of refugee aid and on rebuilding Iraq. I'm deeply concerned that the rift we might be creating now could bit us back in the end on two fronts, in the middle east itself and with a strong europe. But of course that years to come from now but i'm calling it now. Ya I'm being really lazy but I'm stressin out. I've moved from Irvine CA to Long Beach CA in the last month and I've been looking for a new job and thats been a pain in the rear. I'm totally broke. What else, ya I'm going from useing dsl to a land line. That transition is rough. Some good news though, I'm going to Boston to participate in the Harvard National Model United Nations Conference. That should be a blast, I'm representing Switzerland. Its basically an all expences payed trip and I've personally have never been to the east cost so I'm really excited. The farthest east I've ever been is Provo, Utah and yes my family is Mormon if thats what your thinking. If your not thinking that, yes the sking/snowboarding is great there. Anyways I'll try to get some posts up today. I've just finished reading Animal Farm and I'm currently reading White Noise. Why I say that, cuz life is crazy Aminal Farm rocked my senseabilities. Orwell whom I love has such a simple way of writing that you dont realize how imaginitve his work really is. And as an Anarchist he's kind of a role model for the left. Anyways post something new later. See yaz.

LA rally a success
A huge anti-war rally in the streets of downtown Los Angeles finally got some major coverage for the anti-war movement in the United States. Ok I've moved from quiet Irvine to Long Beach/Belmont Shore. Its kind of a shock for me because I have a rough time adjusting to change but I love my neighborhood. The down side is that I will not have internet access at home. I cant afford to pay part of the phone bill and I already have a cell phone so thats my phone. No internet access and no way to pay for dsl/cabel. So classes start in late January then again I can start to post like mad but for now expect a slowdown in posts. If you havent noticed there is a new poster on asianegg. That person is Rust-One. He runs the popular conservativessucks. Him and I are teaming up to give you content beyond belief. But he might be doing the postings for a while. If you want to get on board just let me know I'm always looking for people to scan the net and help asianegg get cracking. So till next time see ya.

Conservative?
A new poll shows that Bush's approval ratings are still high, but more importantly, three quarters of US citizens believe that Bush is a "strong leader." The Republican party is denying there racist past/present and everyone is like ok we accept your apology Lott when the real issue is the party is practicing institutional racism. Lott resined from Mayority Leader position today and is that supposed to be some sort of vindication for the Republican parties actions durring the late 60's to the present in the south. I say F that! Its clear the Democrats has droped there racist past but the Republicans have only payed lipservice and appointed Clarence Thomas, Condalisa Rice and Collin Powell. Thats supposed to show how republicans arnt racist anymore. I got to hand it to Bill Clinton he called it like it is Here is a CNN article about Bill's reaction. The article tells what Bill said then spends the rest of the time trashing him and defending the Republican party. Provoked by the Christopher Hitchens book, filmmakers Jarecki and Gibney have constructed a movie which is both brilliant legal brief and chilling psychodrama. Some of Kissinger's most ardent supporters (Alexander Haig, Brent Scowcroft, William Safire) vie with his detractors (writers Seymour Hersh, William Shawcross, Hitchens himself).

Charges that Kissinger was instrumental in creating the coup that toppled Chilean President Allende, that he undermined LBJ's Vietnam peace talks (prolonging the war by seven years), engineered the secret bombing of Cambodia, and approved Indonesian president Suharto's use of U.S. arms to massacre 100,000 East Timorese have resulted in summonses by five nations seeking to depose him. The film plumbs the depth of one man's soul, as it questions tenets of international law: do war criminals reside only in nations whose interests are inimical to our own -- or are we our own worst enemy?

Not that I know who these people are i.e. good open thinkers or business minded loosers but I guess this is important to someone here is a link to the Members of the National Commission on Terrorist Attacks. I know he's got to make money and why not have people with simular political perspectives pay you to have a kind of liberal pep rally. I would never dogg Rush L. for doing the same thing but is that the same thing? Anyhow good job Michael Moore your movie was good, I hope in your stage show you dont offend your audience too much, Stupid White Men who happen to be liberals and all the non-tenured college profesors who love them. That was supposed to be a funny joke but it reads poorly. Of course the its a pun on the title of his book and just a slight diss on academia but no worries I'd be a stupid white man if I was white and I'd also be an academic if I was more empowered/inclined to be so.

Hay I miss blogging. Its a great analysis of the new Nirvana song "you know your right" Its kinda cool heres a bit of the article: "Here the "you" of the song is clearly the singer himself—the "I" of the preceding couplet. But when the chorus is over, a new target comes into view. "Let's talk about someone else/ Steaming soup against her mouth" the singer suggests, his voice rising back to the same pitch where he left off before. "Nothing really bothers her/ She just wants to love herself." With guitars building to a heavy, industrial crescendo, the accumulated strain in the vocal is again released in the phrase "You know you're right." Repeated over and over again, the singer's attack on himself is now turned against a new target—his wife." Full article text link right here found on the webpages of salon.com.

I dont know what to post. Lots of things have happened but I'm trying to focus my thoughts on a bigger picture so whos to say whats significant as of yet. Trying to aim at a bigger picture is whats keeping me from posting too much stuff. In world news china is going to have its 16th party congress. No matter what you think about China its kind of a neat idea the way the government works. They meet every five years as opposed to what the nine months or so U.S. congress meets. All the deals are backroom closed door type of stuff and for the most part the actuall congress is just pomp and circumstance. The party members meet kinda like how in a primary the dem or republicans meet. And they vote but in China pretty much all the decisions on how one is to vote are already made. Here's a great bbc Q and A about it all. I'll talk about news latter I got to go to lunch now.

Ok this is the last post about the ossuary inscription. It's a hoax a fake so says the isreal insider. Heres the article. I guess all the scientist know this but it never got out to the mass media in the states. This is directly from the article: "The bone-box is original; the first inscription, which is in Aramaic, "Jacob son of Joseph," is authentic. The second half of the inscription, "brother of Jesus," is a poorly executed fake and a later addition." Basically the first half is in aramaic the second part is in hebrew. So I guess that ends the discussion.

Ok Old news but new spin, you know that box with Jesus and his dad Joseph's name on it. Here's a bbc article on how it recently got damaged. My thing is and the bbc article confirms it, it refers to Jesus as a dead brother. You might be thinking well this guy never played sports in a team and dosent see the value or fun it it and your right out side of my swim team expierence in elementary school. I've never played jr leage or high school sports. But that dosent have anthing to do with my arguments against them. Not any sport in particular but the industry as a whole. Sports takes your mind away from the important issues in the world that might other wise be discussed on the local news for example or every sunday and monday. It goal is to take men away from the fact that they cant play sports as well as some and creates a hero worship that is stupid on principle. Look if the average Angel player was like 24 years old why would a fourty year old care about a game played by kids. It dosent make sense to me why dont older men grow out of sports. Why admire what only the youth can do and only a small portion of the youth.

Ok you think North Korea is part of an access of evil. Its probably just the news but It dosent make much sense to me, the logic being that if the news is all about showing blood and gore and if there's always a good amout out there how does the level of viloence on tv rise and fall? Here's another example. Article about the dead in Arizona. What do you think? What causes the level of violence to rise in the media? I'd have to start by saying that it's all about the media mix. Isnt there in a holf hour local news program a set amount of time dedicated b4 it aires. Like 7 mins for weather 9 mins for commercials etc... So the rise of violent content has to do with the amount of the other news thats in the negative I'm assuming that in the same respect what alters the balance could be a rise in quantity of crime being reported by the news services themselves and there could be a flooding of news events. I think when there is lots of international news comming from the wire services thats too complex for the American market maybe that puses alot of junk news on us.

I dont know if anyone of you have the same loving memories of the Sex Pistols as I do.  I can rember it very clearly, it was the summer between Jr. High and High School and I heard Anarchy in the U.K. for the first time on the radio KROQ back in the day when Poor Man was still on and Love Lines was just a local show.  Anyhow I thought the song was so cool, it had the word anarchy in to and it was just a reckless mess of power cords.  I rushed out to buy the album and ever since I've grown to love it.  Not that I've listened to it in a while or anything but it fills a large part of my preteen teen year memories with sounds.  The album is now 25 years old.  Heres a link to a Reuters/Variety Music article that discusses the 1/4 centenial.  Ya the album is just as old as I am, crazy isnt it.  Anyhow I've recently downloaded some PIL or Public Image Limited songs off of Grokster.  PIL is Johnny Rotten's post Sex Pistol band.  It's very cyber pop puck sounding, I know I couldnt be anymore vague but how about this, good songs to download are: diapoined;  World Destruction;  I Could Be Wrong etc...  Man those songs rock as well. Anyways he's the best of the hosts and represents kinda KPFK of the past the station used to be more of an academic (some say "white mans left") radio station, not that it's not academic now or even more so, but the line between facts and propoganda is a bit blurred.  Is that sue to more controverisal subject matter or is that an issue concerning perspectives?  Anway's O ya, John Weiner is also profesor at UCI in Irvine my home town.  Here is the article I liked so much.  I dont know if anyone rembers this but the article is about historian Michael Bellesiles who wrote a book entitled  "Arming America: The Origins of a National Gun Culture"  Basically what the book says is that America didnt have a gun culture untill after the Civil War.  Thus implying that the the right to bear arms stuff the NRA and groups like them are proporting are not justified by looking to America's history.  The article focuses on the campain by some right extreemests to shut him and his reshearch down. Some of the shows I enjoy are:  BBC World service;  Talk of the Nation;  The Tavis Smiley Show;   This American Life;  A Prairie Home Companion;
Wait Wait ... Don't Tell Me; Whad'Ya Know; Rewind; The Infinite Mind. The sad thing is that I listen to all these shows not on a daily basis but I'm always driving at odd hours and up late and early I really do listen to these programs. Anyway I feel guilty cuz I'm broke and I didnt give them any money for the pledge drive but here's my part and by the way I'm a poor student on unemployment I cant pay.

I've been quite busy with school and things so I havent been able to post in a while. Ireland had a system of shared governace with Sinn Fein, there the Catholic rebels. And with the Ulster Unionists party lead by David Trimble. What I heard from an inside source, not nameing names is that in N. Ireland Sinn Fein is growing in numbers and power. They are out forcing the Ulster Unionists out by sheer numbers. The U.U. is the party of Protesets or the party sympathetic to England and they have basically all the money so there the ones threating to break apart the government inorder try and halt any gains that can or would be made by Sinn Fein and in the spirit of post Sept. 11th there useing IRA to dog S.F. Before there was relative peace in N. Ireland the Irish Republican Army or IRA was the militant politcal group fighinting for N. Irish nationalism and independence. But as greater peace in the 90's progressed S.F. was formed to give the IRA a political voice. How conneceted are the two groups today? Well, thats the debate at hand. And even if there joined hand and foot which I'm prevey to believe that dosent mean they share power, think of lets say the House or Represenatives and the Senate in the U.S. they are one body with two groups and they so and dont work together. Anyway there some back round for you.

Ok heres what Media Benjamin of Global Exchange and ex-green party candidate for I think it was Senate in California but I forget. No they didnt, whos guilt of breaking the agreement now, N. Korea, I dont f-in think so. And the other think is if N. Korea has the bomb where do you think its pointed? It's pointed at dam South Korea there brothers. So the U.S. isnt under any direct threat other than the 37,000 troops in S. Korea but there military and what ever tourists business people there. Basically before the book people usually thought that the meaning of words came from what the word was refering to. Example is the meaning of keyboard is the actuall keyboard, or the meaning the word crap is actually real world dung. But it's very easy now to see that words have a context and that the context gives us the meaning not the physical thing the word is trying to describe. Example, Bush is crap. or I love the keyboard player in the band Faith No More. Bush isnt actual dung and if you thought when I used the word keyboard earlier i meant what you type on you where wrong. You remember the term language games? Well that comes from Wittgenstein too. (His name is prounounced: vic-en-stein) Why is language a game you say, because language has rules and movements and pieces and structure and like a game you can use the rules to bend the intent of other rules like lie to decieve or speak in half truths or dominate the meaning of words or use words like terrorist that only denote a connotation not an actuall thing ect...

I'dont know exactly how to interperate this news event. North Korea has openly admitted that it has a nuclear wepons program! Ya, they where forced to admit it after the United States confronted N. Korea with growing evidence of such. Full article here from Reuters. --- Full article from the Assiciated Press. (They slant the issue a bit differently.) I guess only the United States and there allies are allowed to have nuclear wepons no one else. Thats such crap, and if you believe in souvereignty and or deterrence it should be acceptable for N. Korea to have nukes. I'm not advocating countries should have wepons of mass destruction at all, I believe no one should have nukes not even the U.S. U.S. hegimony needs to be challenged at all times to scale it back from the harm it can do to others and itself. The last thing in the world I want to see is America invading N. Korea for dam sakes, they already have 37,000 troops in Soth Korea and thats an occupation in my book. Althought it may be agreeded to by the government of S. Korea you know the people would vote them out any day given the chance. I'm worried as a Korean American that this admition in the current political air could lead to something ugly. They are part of the axis of evil openly admitting to having nuclear wepons if this somehow takes attention away from Iraq thats not good for Korea. Man this new world order is wacked beyond all belief. What I'm praying for is that the oil argument holds true and not the hegomonic world order argument for answer to the question why now why Bush. Cuz N. Korea dosent have oil, so it should be ok given that rational. I tried to go to the cia website to see what natural resources they do have and I couldnt find anything. If the why now argument is about american hegemony and not necessiarly oil then N. Korea is skrewed. The residual legacy of post-911 policy implimented by the United States is to strengthen state power in all its forms for good or bad that depends on your politics I guess. I'm one that tends to see's the illigimacy of state powers from the perspective of a libertaian socialist. Thats anarchist for eveyone not familuar with the term. But what I wanted to discuss is whats going on in N. Ireland. Heres the A.P. article that discusses it. This is a mad political move on the part of England. And as I see it an abuse of state power otherwise known as imperialism. Empireing is in the British tradition, the state cant figure out how to treat people fair and give back there just due to a nation they have exployted for years now there way of dealing with it is to take away there independence. Whats goin on here? Why not free them and give N.Ireland its Nationhood instead of taking it away? At least that way you can have them fend for themselves and you can remove all your troops from there and then you can declare war on them if Shin Fein is as bad as they claim it to be, which I doubt. This just draggs a conflict and creates more resentment. And the analogies to other independent movents is too stong to ignore the Kurds, the Palestineans and Basqe ect... What the british government wants to do amount to genocide of at least culture and worst a population. Persident Bush offered to help England, hasnt he done enough. Here's the article that discusses that. Anyhow what do you think.

I'm not as big a follower of Latin America as I should be but but I fould this article that talks about the IMF and what restructureing of a debter nations government looks like. Link to article here. Apparently, the supreme courts in Argentina have been stricking down all the strucural readjustment policyies of the new President Eduardo Duhalde of the Peronist party. And the government was debateing weather or not to impeach the nine justices of the court. Basically if you owe money to the IMF and you want/need more, they give you loans with strings attached. Your country has to do what the IMF tells you to do usually liberaize your economy Thatcher/Regan style. Cut as much money out of the government as possible welfare programs usually the first to go and open up your economy to foreign investors and sell off any state owned industries. Well this ususally leads to disaster so the countries are so cash dependent they usually have little choice. The congress decided not to impeach the justices. Argentia wants IMF money, it's gonna get them deeper into debt, what do you think about this?

U.N. What the U.S. wants is an either or resoultion, you do as we say or else war. What do you think we should do? And by the way thats 20,000 $'s. Ok I hear alot of people on the anti-war camp saying two different things basically. One camp says oil, "no blood for oil" can pretty sum up there position. And It correct for sure Con-da-lisa Rice has a freaking oil tanker named after her, she's still on what is it exxon's board of directors and she's republican to boot. Bush and his family are down right homies with the Saudi Royal family. I'm almost dead sure they've gone on vacations together and didnt pay taxes for it cuz they called it a business expense. I dont quite know the oil ties of Rumsfeld and Cheney but there there and anyway's what was stated is enough to influence foregin policy in a negative way. So the argument goes that we are going to war in order to gain access to oil an energy resourse. The other main line of thinking I here is that this war is a war concerning globilization. The U.S. is the top dog in enforcing rules and standards of globilization so much so that we now will tell other countries who there leaders can and cant be, the neo-colonial line. So this war and others like it are being fought in the name of market disclipine. We will show the world they must keep there economies working to service the core states in the world order or else we will topple you. Thats why Russia will eventually agree and so will the EU and Japan and ever other industrial nation because its in the First worlds intrest to break the back of all other states. If you think about it we control have a hand in just about every government in the middle east. We demand the diarmament of Iraq while Isreal has nuclear wepons. The world is a smaller place that now incorporates small farmers in Iraq and child laborers in India. We need to display the force of that order some how because the liberalization of world economics is showing its ugly head and residence is mounting. Why not use Iraq to do that, you get oil and son Bush get to finish the task of Dad Bush and it creates genuine patriotism/republican votes, better than any movie plot in the theaters now.

Of course there is no simple answer but I'm sure its a combination of the both. In order to believe it I guess you have to assume that the reason Bush gives for going to war are face value reasons not that they arnt true or intellectually valid but that an they arnt his only reasons. There is little mutual ex-clue-tiv-ity in the left and right arguments over this war I think thats whats so confusing to most people. the devils in the details and the administration holds the medias keys and reporters dont care anyway, would you like to just tape a presidents speech and present clips of it or would you do all this extra research, risk your job, convince your boss to give you money to hire an "expert" to analysis the claims and strive to be objective when you you could just smile and resite point by point Bushes speech. I'm kinda on a posting hi-ay-tuss for two reasons. The first is that I have to get my school work done and the second is that I'm on a news burnout. Things are setteling in on the political front with the climax being Bushes speech and What I'm guessing is gonna be the passing of war powers to the Pres by the House and Senate. I know that its no small order but just to say it passed or will is good enough the little details are gonna be lost in the winds of time and importance. Here is an A.P. article that explaines my point you can read it here.

The florida thing is still goin on and thats a bit scarry now with the shooting of a child. I'd bet a million dollars that the killer went and saw Red Dragon the movie. Shit, my crazy friends saw the movie and liked it none the less. Me, I'll pass on big budget low grade cinema part threes. Heres an article about the shooting deaths. This thing is getting pretty crazy and the politicization of the investigation is bad too. I guess I never really payed attention to media's micro-management of high profile case investigations but I guess It points out how bad cops really are, no wonder they make evidence up and lie all the time, they cant even make a steady donut scheduel.

Yo check out these supreeme court cases comming up soon. I'm just cutting and pasteing the 2nd half of the article, its that informative.
Crucial Issues Wait in Wings for the Justices
Mon Oct 7, 9:04 AM ET
By LINDA GREENHOUSE The New York Times

Here is a look at some of the more important cases on the new term's docket.

CRIMINAL LAW
On Nov. 5, the court will examine California's three-strikes law, the most harsh in the country, and decide whether the law's mandatory 25-years-to-life sentences amount to cruel and unusual punishment when the third strike is a minor property offense. In Lockyer v. Andrade, No. 01-1127, the defendant stole videotapes worth $153.54 from two Kmarts. In Ewing v. California, No. 01-6978, the defendant stole three golf clubs from a pro shop.
On Nov. 13, the court will hear two challenges to Megan's Laws, under which all 50 states publicize the whereabouts of convicted sex offenders after their release from prison. In a case from Alaska, Smith v. Doe, No. 01-729, the question is whether the state's 1994 law operates as an unconstitutional ex post facto law when applied to those whose crimes preceded its enactment. In Connecticut Department of Public Safety v. Doe, No. 01-1231, the issue is whether listing all offenders in a registry violates the due process guarantee when the list makes no distinction among those who are more or less likely to commit new offenses.
United States v. Recio, No. 01-1184 (Nov. 12), is a government appeal on a question of conspiracy law that takes on added importance in the current climate. The question is whether a conspiracy should be deemed to have ended when the government frustrates its objective by intercepting a shipment of narcotics, for example, as in this case. The government's view is that participants can still be prosecuted in a conspiracy even if by the time of their arrest, the conspiracy could not have been carried out.
Chavez v. Martinez, No. 01-1444, (no argument date yet) raises another timely question: whether police interrogation can be unduly coercive, under the Fifth Amendment's prohibition against compelled self-incrimination, when the resulting statements are never introduced in court.
A case touching on federal gun control policy is United States v. Bean, No. 01-704 (Oct. 16). The question is whether federal judges have jurisdiction to lift the "firearms disability" that makes it unlawful for someone convicted of a felony to own or carry a gun.
A 16-year-old lawsuit over blockades and other obstructive tactics used by protesters at abortion clinics raises the question of whether the federal laws against racketeering and extortion can be invoked to stop and punish disruptive protests. The National Organization for Women ( news - web sites) brought the suit on behalf of clinics in 1986 and survived an earlier Supreme Court challenge. The new case is Scheidler v. N.O.W., No. 01-1118 (no date).
COPYRIGHT
The most important intellectual property case in years challenges the 1998 law that extended the terms of new and existing copyrights by 20 years, to 95 years for corporations and the author's life plus 70 years for individuals. The plaintiffs in Eldred v. Ashcroft, No. 01-608 (Oct. 9), are advocates for the "public domain" who argue that the extension subverted the Constitution's authorization of a copyright monopoly for "limited times."
HATE SPEECH
Virginia is defending its 50-year-old law that makes it a crime to burn a cross "with the intent of intimidating any person or group of persons." The Virginia Supreme Court declared the law unconstitutional on the ground that under the First Amendment, the government may make intimidation a crime but not by singling out the "distinctive message" of a burning cross. The case, Virginia v. Black, No. 01-1107 (no date), gives the court its first chance in 10 years to consider regulation of hate speech.
FEDERALISM
The court's battle over the balance between state and federal powers continues with a case that challenges Congress's authority to require states to give their employees unpaid leave to deal with family medical emergencies. In Nevada Department of Human Resources v. Hibbs, No. 01-1368 (no date), Nevada argues that Congress exceeded its authority under the 14th Amendment when it tried to open the states to suits by their employees under this provision of the Family and Medical Leave Act of 1993. The case has wider implications for civil rights legislation.
IMMIGRATION
In Demore v. Kim, No. 01-1491 (no date), the court will decide the constitutionality of the mandatory detention provision of a 1996 immigration law. The law requires immigrants who are facing deportation for any of a long list of offenses to be held without a chance for release on bond even if they present no risk of flight. Three federal appeals courts have rejected the government's defense of the law.
PUNITIVE DAMAGES
Businesses are paying close attention to an appeal by the State Farm insurance company from a decision of the Utah Supreme Court that upheld a $145 million punitive damages award, 145 times the compensatory damages awarded to the plaintiffs on their claim that the company acted in bad faith. Besides challenging the award as disproportionate, State Farm v. Campbell, No. 01-1289 (no date), also questions the state court's consideration of out-of-state evidence involving other State Farm customers who were not before the court.
HEALTH CARE
For the second straight term, the court will review a state's effort to regulate aspects of managed care. Kentucky Association of Health Plans v. Miller, No. 00-1471 (no date) is a challenge to Kentucky's "any willing provider" law under which any qualified doctor has the right to become a participating provider in a health plan. Half the states have such laws, and the question is whether they are preempted by federal law.
In Pharmaceutical Research and Manufacturers of America v. Concannon, No. 01-188 (no date), the court will hear the drug industry's challenge to a Maine law that tries to use the federal Medicaid law as leverage to force drug manufacturers and wholesalers to sell to their products in the state at discounted prices.

I need to post something to see if my comments site is working so heres some pic's of a naked star fleet commander. It's friday and I think everyone's getting ready for the weekend. In DC/Maryland is it five people where shot to death at random. Sounds like that persons got a bad case of the "citys", too much stress and not enough of the support network.
The election scandel in New Jersey is heating up. Dam its so funny that so much is at stake in this election. And the democrats need all the help they can get in keeping the Senate but blasted, the letter of the law not the spirit or is it the other way around.
The whole U.N. resolution debate is about to end with Bush accepting a compremise of two resolutions. Iraq you must do what we say.....2nd resolution, or else we will invade. Was the U.S. being a stickle they freaking got what they wanted in the end but the language isnt to U.S. standards. I think there is a marked difference between how the U.S. uses language as opposed to the restof the world. America demands vagueness through big words while the world assumes vagueness through ignoring the language all together.
The war on terrorism is truely international you got Johnny Walker (Blue Label) in Afganistan. You got Richard Reid, shoe bomber savant in the U.S. those dam Londoners are jumping the sinking ship of England and comming over here and were suckers for the language. Assitant Sec. of State is in North Korea telling the N. Koreans they need to dis-arm and never mind the 25,000 troops that line there boarder. You have the american military all over the place supporting every counter-insurgancy movement i.e. supporting dictators in Indonessia, Afganistan, Colombia ect... And even in colombia you have IRA members teaching the natives how to survive and oppressive governments. And in Ireland itself the folks are fighting hard. Of couse Isreal is hammering on the Palestinians telling them to get off there land. What happend to John Lock's original ownership argument? Africa you say, all hell is still there. Too much debt slavery very alive and well and everywhere you look peace is happening only beacuse yesterday there was war. Ivory Coast, South Africa, Republic of Congo, Morocco, Nigeria ect ect...
So thats not even a glimpse of the world but anyhow.

Here's a forward I got from Rust-One. Does the advent of megabrands like Starbucks and the Gap give consumers more or less choice? Where do citizens stand in the shifting balance between government and
business? Naomi Klein, brand-skeptic, and Sameena Ahmad, label-lover, disagree on nearly all the questions.
